Employers’ common law duties:
Duty of mutual trust and confidence.
To provide work for workers, only where employee is an apprentice, employee is paid on the basis of work done, or opportunity to work is the essence of the contract. But if there is no work available and yet the employer continues to pay its employees, there is no breach of this duty.
To pay wages/remuneration.
To indemnify employee against expenses and losses.
To provide for the care and safety of the employee.
